Criminal liability for medical malpractice in Ecuador: A legal approach to evidence and proof [Responsabilidad penal por mala práctica médica en Ecuador: Enfoque jurídico de prueba y evidencia]

The research focuses on the analysis of one of the new features introduced by the Comprehensive Organic Criminal Code, which has generated widespread social debate: the criminal offence of manslaughter due to professional malpractice within the catalogue of crimes. Understanding this conduct, understood as a breach of the objective duty of care, represents a complex challenge. For this reason, the dogmatic categories of the crime, consolidated in national case law, were addressed in depth. From an eminently procedural perspective, the above was presented in terms of evidence, not in abstract terms, but through the analysis of a specific case. This section included the study of the applicable means of evidence; the evaluation of judicial assessment in the different instances; and, finally, the legal assessment of the appropriateness of the application by judges, lawyers and prosecutors of Article 146 of the COIP.
